Our Commitment

Games4Kids respects the intellectual property rights of others and expects our users to do the same. We will respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

1. Copyright Infringement Notification

If you believe that content on Games4Kids infringes your copyright, please provide our Designated Copyright Agent with a written notification containing the following information:

Required Information for DMCA Notice:

  1. Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (including specific URLs).
  3. Your contact information, including:

  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature (or the signature of a person authorized to act on your behalf).

Important Notice

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. Please consult with your legal advisor before submitting a DMCA notice.

3. Counter-Notification Procedure

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent with the following information:

  1. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information:

  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the federal district courts located in [Your District] if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your physical or electronic signature.

4. Our Response Process

4.1 Upon Receipt of Valid DMCA Notice

  • We will remove or disable access to the allegedly infringing content
  • We will notify the content provider of the takedown
  • We will document the notice and our actions

4.2 Upon Receipt of Valid Counter-Notice

  • We will forward the counter-notice to the original complainant
  • We will inform them that we will restore the content in 10-14 business days
  • We will restore the content unless the complainant files a court action

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Games4Kids has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights of others.

6. Fair Use

Games4Kids recognizes that the fair use doctrine permits limited use of copyrighted material for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. Our educational content about video games often falls under fair use, including:

  • Screenshots for educational and review purposes
  • Brief quotes from game descriptions
  • Commentary and criticism of games
  • Transformative use for parental guidance

7. Our Content

Most content on Games4Kids is original and created by our team. Where we use third-party content, we ensure proper licensing or fair use. This includes:

  • Original articles and guides
  • Educational commentary and analysis
  • Properly licensed stock images
  • User-submitted content (with appropriate rights)

8. False Claims

Please note that under Section 512(f) of the DMCA, you may be liable for damages (including costs and attorneys' fees) if you knowingly materially misrepresent that material or activity is infringing. If you are unsure whether material infringes your copyright, we suggest consulting an attorney.

9. No Admission of Liability

Games4Kids's response to DMCA notices should not be construed as an admission that we have displayed or transmitted infringing material. We reserve all rights and defenses available under law.

10. Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to the Website. Your continued use of the Website after any changes indicates your acceptance of the modified policy.
